If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy and website disclaimer, govern helenbillows.com’s relationship with you in relation to your use of this website.
1 ABOUT THESE TERMS
These Terms and Conditions govern your access to and use of helenbillows.com (the Website) and any free or paid digital products, courses, recordings, live educational components, downloads and other resources supplied through or in connection with the Website (Products).
The Website and Products are operated and supplied by Helen Billows, sole trader, ABN 14 155 100 303. References in these Terms to "Helen Billows" are references to Helen Billows in that business capacity. References to "you" or "your" mean the person accessing the Website, requesting a free resource, creating an account, purchasing a Product or otherwise using the Website or a Product. You can contact Helen Billows at hello@helenbillows.com.
Helen Billows operates both helenbillows.com and Billows Psychology as a sole trader under ABN 14 155 100 303. They are not separate legal entities, but they operate in distinct service contexts. Billows Psychology is the clinical practice through which psychological therapy, supervision and consultation are provided. helenbillows.com is the non-clinical educational platform through which digital products, courses, free resources, newsletters and related educational content are provided. The terms, privacy information, consent processes, fees and cancellation arrangements applicable to one service do not automatically apply to the other.
By accessing the Website, requesting a free resource, creating an account or purchasing a Product, you agree to these Terms to the extent relevant to that activity. When you purchase a Product, the product description, checkout information and any specific terms displayed before payment also form part of your agreement with Helen Billows.
If you do not agree to these Terms, do not continue to use the Website, request a free resource, subscribe to the mailing list, create an account, purchase a Product or access or use any Product.
2 ELIGIBILITY
The Website and Products are intended for adults aged 18 years and over. By purchasing or using a Product, you confirm that you are at least 18 years old and have legal capacity to enter into a contract.
3 NATURE OF THE PRODUCTS
The Products provide general education about psychology, trauma, emotional responses and related topics. Depending on the product description, a Product may contain recorded video or audio, written lessons, downloadable worksheets, saved progress or completion data, live educational questions and answers, or general feedback on submitted questions.
Products are not clinical psychology services. They do not include psychological assessment, diagnosis, treatment, crisis support, an individual treatment plan or personalised clinical advice. Purchasing or using a Product does not create a psychologist-client, therapist-client, patient-practitioner or other clinical relationship with Helen Billows or Billows Psychology.
4 PRODUCT INFORMATION AND ORDERS
Helen Billows takes reasonable care to describe each Product accurately, including its main content, format, price, access period and any live components. Please review that information before purchasing.
If a product page or checkout contains a specific term that is inconsistent with these general Terms, the specific term applies to that Product to the extent of the inconsistency. No product-specific term excludes a right that cannot lawfully be excluded.
Submitting an order is an offer to purchase the Product on the displayed terms. An order is accepted when payment is approved and an order confirmation or access instructions are issued. Helen Billows may reject or cancel an order before acceptance if there has been an obvious pricing or description error, suspected fraud, technical error or product unavailability. If payment has already been taken for an order that Helen Billows cancels, Helen Billows will return that payment.
You must provide accurate contact and payment information. You are responsible for keeping the email address connected with your purchase current so that access notices and important product communications can reach you.
5 PRICES GST AND PAYMENT
Prices are displayed and charged in Australian dollars and include GST unless the checkout expressly states otherwise. Your bank or payment provider may charge currency conversion, international transaction or other fees. Those fees are outside the control of Helen Billows.
The payment options for each Product are stated on its product page or at checkout. A Product may require one upfront payment or offer payment by instalments.
Where a fixed-price Product is offered by instalments, the instalment arrangement is a payment plan for the total purchase price, not a subscription that can be cancelled part way through. Unless the checkout expressly states that an arrangement is cancellable, all scheduled instalments remain payable after access is supplied, subject to your rights under the Australian Consumer Law.
Payments are processed by third-party payment providers, including Stripe or PayPal where offered. Their own terms and privacy practices also apply to their services. Helen Billows does not receive or store your complete payment-card number.
If a scheduled payment fails, Helen Billows may give you an opportunity to update the payment method and may suspend access while an amount remains overdue. This right will not be exercised in a way that excludes or limits a right you have under applicable law.
6 DELIVERY AND ACCESS
Access instructions are ordinarily sent to the email address used at checkout. If you do not receive access instructions within a reasonable time, first check your spam or junk folder and then contact hello@helenbillows.com.
Paid self-paced courses include 12 months of access beginning on the date access is first made available, unless a longer period is expressly stated on the product page. Access ends automatically when that period expires. You are responsible for downloading any downloadable resources you wish to retain before access expires.
Downloaded materials may be retained for the uses permitted by the licence in section 7. Course-platform access, streamed video, streamed audio, updates, support and live components do not continue after the access period unless expressly stated.
You are responsible for having a suitable device, internet connection, software and email account. Helen Billows may carry out reasonable maintenance or replace a service provider. If a change would materially reduce a paid Product during its promised access period, Helen Billows will take reasonable steps to provide substantially equivalent access or another remedy required by law.
Dates, eligibility, attendance arrangements and replay availability for live components will be stated on the relevant product page or session notice. A replay is not included unless it is expressly promised.
7 INTELLECTUAL PROPERTY AND PERMITTED USE
Unless otherwise stated, the Website and Products, and all intellectual property rights associated with them, belong to Helen Billows or are used by Helen Billows with permission. This includes business and trading names, domain names, logos, registered and unregistered trade marks, branding, website design, layout, look and appearance, graphics, photographs, illustrations, text, lessons, frameworks, recordings, downloads, worksheets and presentation materials.
When you obtain a Product, you receive a limited, non-exclusive, non-transferable licence to use it for your own private learning during the stated access period. You may download and print resources that are made available for download and retain those copies for your own ongoing personal use.
You must not, without prior written permission:
share, sell, sublicense, lend or transfer your login or access;
copy, record, reproduce or distribute lessons, videos, audio or other course content except for a download expressly provided to you;
upload Product content to a shared drive, public website, social platform, file-sharing service, artificial intelligence system or other third-party database;
remove branding, copyright notices or attribution;
modify, translate or create derivative commercial products from Product content;
use Product content to train other practitioners, deliver a group program or workshop, or create a competing product;
represent Product content as your own; or
use a Product for an unlawful purpose.
8 LIMITED PERMISSION FOR THERAPIST PURCHASERS
A therapist who lawfully purchases a Product may, in addition to their own private learning:
print a resource that is clearly designated for client use for an individual current client;
email that designated resource directly to an individual current client; and
show brief excerpts from Product content during an individual client session.
This limited permission does not allow the therapist to give a client access to the course, share recordings or complete lessons, place files in a shared client library, use materials in groups or workshops, remove or alter branding, sell the materials separately, or use the materials to train other practitioners. A therapist remains responsible for exercising their own professional judgment and deciding whether any resource is appropriate for a client. Unless expressly stated, a Product is not accredited professional training or continuing professional development.
9 ACCOUNTS AND SECURITY
An account is for the registered purchaser only. You must keep login details confidential and notify Helen Billows promptly if you reasonably suspect unauthorised access. You are responsible for activity through your account to the extent that it results from your failure to take reasonable care of your login details.
Helen Billows may suspend access where reasonably necessary to investigate fraud, a security risk, unauthorised sharing or a material breach of these Terms. Except where urgent action is reasonably required, Helen Billows will give notice and a reasonable opportunity to address the issue. Access may be terminated for a serious or repeated breach. This does not affect any right or remedy that cannot lawfully be excluded.
10 LIVE EDUCATIONAL SESSIONS AND SUBMITTED QUESTIONS
Any live session or response to a submitted question is educational. Helen Billows may apply a general framework to a question or suggest general next steps or resources, but will not provide psychological assessment, diagnosis, treatment planning or personalised clinical advice through a Product.
Please do not submit names, contact details or other information that identifies another person. Do not submit detailed clinical histories, crisis disclosures or information that you would only want to share in a confidential treatment relationship. Questions may be declined, shortened, edited or de-identified, and there is no guarantee that a question will be answered.
Some questions may be submitted without a name. An identified email or form submission is not clinically confidential merely because the subject matter relates to mental health. The collection and handling of personal information is explained in the Privacy Policy.
If other participants attend a live session, do not record, photograph, screenshot, copy or distribute another person's contribution. Participants must communicate respectfully. Helen Billows may remove a participant whose conduct is unsafe, abusive, disruptive, unlawful or seriously infringes another person's privacy.
Helen Billows cannot guarantee that another participant will keep information confidential. For that reason, participants should not share sensitive personal details during a live session.
11 RECORDINGS
A live session will only be recorded where this is disclosed before the session. The session notice will state the intended use of the recording and whether participant names, images, voices or chat messages could be included.
Helen Billows will seek express consent before including an identifiable participant contribution in a recording. Where the session format permits, a participant who does not want to be identifiable should keep their camera and microphone off, use the available anonymous question process and avoid entering identifying information in chat. A separate recording notice or consent presented for a particular session forms part of these Terms.
Participants must not make their own recording of a live session.
12 YOUR WELLBEING AND SAFETY
Psychology and trauma-related material can sometimes bring up discomfort, distressing memories or strong emotions. You are responsible for deciding whether and when to engage with a Product. You may pause or stop at any time and seek support from an appropriately qualified professional.
The Website, Products, question forms and email address are not monitored crisis services. If you or another person is in immediate danger in Australia, call 000. For 24-hour crisis support in Australia, call Lifeline on 13 11 14. If you are outside Australia, contact your local emergency or crisis service.
13 NO GUARANTEED RESULT
People differ, and psychological education affects people differently. Helen Billows does not promise that a Product will produce a particular emotional, psychological, relational, professional or other outcome. Examples and illustrations are provided to explain concepts and are not predictions about your circumstances.
14 REFUNDS AND AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
Because digital access is supplied shortly after purchase, Helen Billows does not provide a refund merely because you change your mind after access has been issued, unless a specific written guarantee on the product page says otherwise.
You may nevertheless be entitled to a repair, replacement, re-supply, cancellation, refund or other remedy where required by the Australian Consumer Law. The appropriate remedy depends on the nature and seriousness of the problem. If a Product is faulty, materially different from its description, not supplied with due care and skill, or cannot be used for its stated purpose, contact hello@helenbillows.com with your order details and a description of the issue.
If a technical problem can reasonably be fixed, please allow a reasonable opportunity to investigate and correct it. This does not reduce any right you have to a remedy for a major failure.
Failure to use a Product, attend an available live component, download a resource before access expires or complete the course does not by itself entitle you to a refund. If Helen Billows cancels an advertised live component and does not provide a reasonable rescheduled session or suitable alternative, Helen Billows will provide any remedy required by law having regard to the importance of that component to the Product.
15 WEBSITE AVAILABILITY AND THIRD-PARTY SERVICES
Helen Billows takes reasonable steps to keep the Website and Products available and secure, but internet services are not error-free. Access may occasionally be interrupted by maintenance, security events, service-provider outages or circumstances beyond reasonable control.
Helen Billows uses reasonable technical and organisational measures to support the security and operation of the Website and Products. However, no internet transmission, website, server, course platform or downloadable file can be guaranteed to be uninterrupted, error-free, completely secure or free from viruses or other harmful components. You are responsible for maintaining appropriate device security, software updates and malware protection when accessing the Website or downloading material.
To the maximum extent permitted by law, Helen Billows is not liable for loss caused by malicious code, unauthorised third-party interference, service-provider outages or other security events outside Helen Billows’s reasonable control. Nothing in this paragraph excludes or limits any legal obligation, consumer guarantee, right or remedy that cannot lawfully be excluded or limited.
The Website and Products may contain links to or rely on third-party services. A link does not necessarily mean that Helen Billows endorses all content, products or practices of the third party. Your direct use of a third-party service may also be governed by that provider's terms and privacy policy.
16 ACCEPTABLE USE
You must not:
attempt to gain unauthorised access to the Website, a Product or another person's account;
interfere with security, access controls or normal operation;
introduce malicious code or use automated scraping or extraction tools;
use the Website or a Product to harass, threaten, defame or unlawfully identify another person;
infringe intellectual property, privacy or other legal rights; or
use the Website or a Product in breach of applicable law.
17 LIABILITY
The Website Disclaimer forms part of these Terms.
To the maximum extent permitted by law, Helen Billows is not liable for indirect or consequential loss that was not reasonably foreseeable when you acquired the Product, or for loss caused by your unlawful use, unauthorised sharing, failure to follow reasonable technical instructions, or a third-party event outside reasonable control.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability, guarantee, right or remedy that cannot lawfully be excluded or limited.
18 PRIVACY
Personal information is handled in accordance with the Privacy Policy published on the Website. Separate privacy information applies to clinical psychology services supplied through Billows Psychology.
19 CHANGES TO PRODUCTS AND THESE TERMS
Helen Billows may make reasonable corrections, updates and improvements to the Website and Product content. During a paid access period, Helen Billows will not intentionally remove a material part of the purchased Product without providing substantially equivalent content or another remedy required by law.
Helen Billows may update these Terms for future use of the Website or future purchases. The terms accepted when an order was placed will continue to govern that purchase unless a change is required by law or you expressly agree to the change. The latest version will be published with its effective date.
20 GENERAL PROVISIONS
If part of these Terms is unlawful or unenforceable, it is to be read down to the extent necessary or severed, and the remaining terms continue to apply.
A failure or delay in enforcing a right is not a waiver of that right.
These Terms, the relevant product description, the checkout information and any specific written terms shown before purchase form the agreement concerning that Product.
21 GOVERNING LAW
These Terms are governed by the laws of South Australia and the applicable laws of the Commonwealth of Australia. The courts of South Australia have non-exclusive jurisdiction. If you live elsewhere, you retain the benefit of any mandatory consumer protection that applies to you and cannot lawfully be excluded by contract.
